Terms and Conditions: Happy Retriever
Happy Retriever is a company registered in the Netherlands with KvK Number 98954385, VAT Number NL868718737B01, and NVWA Feed Registration number PET2001-NL-216994 and STOR FEED and Retail FEEDM FEED Registration number NL 231054. These Terms and Conditions apply to all users of the Happy Retriever website and all purchasers of our specialized retriever supplements across Europe.

Applicability and Agreement
1.1 These Terms and Conditions apply to all offers, agreements, and deliveries by Happy Retriever to both individual consumers (B2C) and professional business entities (B2B) within Europe.
1.2 By placing an order or starting a subscription, the Customer agrees to these terms.
1.3 Any deviating terms from B2B partners are explicitly rejected unless agreed upon in writing.

Mandatory Usage Guidelines
2.1 Target Breed: Our products are “Complementary feed for dogs” formulated specifically for the physiological needs of retriever breeds.
2.2 Strict Dosage: The customer is solely responsible for adhering to the recommended dosage: 1 chewy per 10 kg of body weight.
2.3 Storage: Products contain sensitive ingredients, and therefore they must be stored in a cool and dry place.

Exclusion of Liability for Misuse & Health
3.1 Assumption of Risk: Happy Retriever shall not be held liable for any adverse health effects, injuries, or medical conditions arising from:

Overdosage: Administering more than the recommended amount.

Off-Label Use: Administering the product to animals other than dogs or non-retriever breeds.

Pre-existing Conditions: Failure to consult a veterinarian regarding a dog-s specific medical history.
3.2 No Guarantee of Specific Results: Our products are nutritional supplements designed to support health. Due to the unique biological makeup, age, and health status of individual dogs, Happy Retriever does not guarantee specific results or a particular effect. The absence of a perceived physical change or “effect” in the dog does not constitute a product defect and does not entitle the Customer to a refund or compensation.
3.3 Not a Medicine: Our products are supplements, not veterinary medicines. Happy Retriever is not liable for the Customer’s decision to use supplements in place of professional veterinary treatment.
3.4 Improper Storage: We are not liable for spoiled products resulting from a failure to store items in a cool, dry place.

Subscription Model (B2C)
4.1 Renewal: Subscriptions renew automatically at the frequency selected.
4.2 Cancellation: Must be processed via the account dashboard at least 48 hours prior to the next scheduled billing date.
4.3 Right to Retain Payment: If a cancellation is not made at least 48 hours before the billing date, Happy Retriever reserves the right to keep the payment, and the order will be processed as scheduled. No refunds will be issued for cancellations requested after this window.

Right of Withdrawal
5.1 Hygiene Seal Exception: In accordance with Article 16(e) of the EU Consumer Rights Directive, the right of withdrawal expires immediately once the protective hygiene seal is broken or removed.
5.2 Non-Returnable: For food safety and health protection reasons, Happy Retriever strictly maintains a zero-tolerance return policy for opened goods. We cannot accept returns, nor will we provide any refunds or credits for pouches that have been unsealed, opened, or tampered with under any circumstances. This applies even if the product has only been “tried” once.

Professional & B2B Clauses
6.1 Finality: All B2B sales are final. There is no right of withdrawal for professional entities.
6.2 Inspection & Complaints: B2B customers must inspect goods upon delivery. Any defects or shortages must be reported in writing within 48 hours of receipt. Failure to do so constitutes full acceptance.
6.3 Payment Terms: Late payments will incur statutory commercial interest and any collection costs.
6.4 Retention of Title: Happy Retriever retains full ownership of all goods until the B2B customer has fulfilled all payment obligations.
6.5 Consequential Loss: Happy Retriever is not liable for indirect damages, lost profits, or business interruption of the B2B partner.
6.6 Third-Party Indemnification: Happy Retriever is not liable for any claims, damages, or health issues raised by the end-customers of our B2B partners. The B2B partner assumes all responsibility for the advice, storage, and sales practices they provide to their own clientele and shall indemnify Happy Retriever against any such third-party claims.

Third-Party Platforms and Marketplaces
7.1 Platform Precedence: For marketplace sales (e.g., Bol.com, Amazon, among others), the platform’s transaction terms may apply.
7.2 Product’s Liability: The Exclusion of Liability (Section 3) and Hygiene Seal Exception (Section 5) remain fully applicable regardless of the sales platform.

General Liability & Governing Law
8.1 Maximum Liability: Our total liability is strictly limited to the purchase price of the specific order.
8.2 Governing Law: These terms are governed by the laws of the Netherlands. Any dispute shall be submitted to the exclusive jurisdiction of the Dutch courts.
